Supporting Technical Studies
The forest ecosystems are defined as the basic functional unit of interaction of forestry among themselves and with the environment in certain time and space. To change soil use in forest land refers to the total or partial removal of the vegetation of the forest land to non-forest activities.
Secretary of environment and natural resources (SEMARNAT) reads as follows the General guidelines with regard to changes in the land of forest land use and defines them in the following way:
 
• Forest land: The land which is covered by forest vegetation.

• Preferably forest terrain: One terrain which has been but at present is not covered by forest vegetation, but by their conditions of climate, soil and topography is more apt for forest use than for other alternative uses, excluding those already urbanized.

• Forest vegetation: The set of plants and fungi that grow and develop naturally forming forests, forests, arid zones, and other ecosystems, leading to the development and balanced coexistence of other resources and natural processes.

The Technical Study Justifying (TSJ) refers to the data sheet of design, planning and follow-up that describes actions and procedures of protection, preservation and restoration of forest ecosystems. The TSJ must state that the provisions referred to in the applicable federal regulations in relation to the processes of change of land use in forest land have been carefully reviewed and constitute direct axis through which the different sections of this study is prepared; in particular, pursuant to article 121 of the rules of procedure of the General Law on forestry sustainable development.

The TSJ must comply with the requirements established by law some of them are as follows:
• Demonstrate that the project does not compromise the biodiversity.
• Do not lead to the erosion of soils.
• Avoid deterioration in water quality or decrease in its catchment.
• Alternatives proposed long-term land-use change is more productive than the previous.
• No authorization for change of land use in a burnt area may be granted unless they have spent 20 years.
• Permits which are issued must pay attention that in their case, have programs for ecological zoning, the Mexican official standards and other Mexican legal provisions and other applicable legal and regulatory provisions.
 

The article 34 fraction XV of the General Law on forestry sustainable development, the article 118 of the same law stipulates the obligation to make a deposit at the Mexican Forestry Fund by environmental compensation for reforestation or restoration of forest land and its maintenance activities, in the terms and conditions established by the regulation.

The sanctions by making a change of land use in forest land without authorization, for the development of the project, it is an offence to the General Law on forestry sustainable development and an environmental crime in the federal order, being sanctioned by the Federal Attorney for protection to the environment (PROFEPA), sanctions range from economic fines to cancellation of the project depending on the seriousness of the offence. In CAM, we specialize in developing projects that comply with the regulations and environmental legislation that establishes the federal Government concerning the implementation of TSJ's, we also have staff specialist for the design, development and implementation of TSJ's CAM staffed with national forest logging, this registration is a fundamental requirement to enter a request for change of land use with SEMARNAT CAM services for the implementation of an TSJ are the following:

• Planning design and implementation of the field sampling, Studio dasometric.
•Mitigation and environmental compensation measures.
• Rescue and relocation of species listed in the NOM-059 – 2010.
• Drafting of the study (15 chapters).
• Presentation delivery and follow-up to the resolution of SEMARNAT. .
• Identification of species.
• The timber volume calculation..
• Environmental legislation applied to the project
 
The SEMARNAT provides a response within 60 working days. The deadline will be under the following procedure: 15 working days to integrate the file. 15 working days from the date of notification so that the person concerned to provide information or missing documentation send it. The Secretariat shall send copy thereof to the Council state forest that corresponds to this, within a period of 10 working days following its receipt, to give its opinion.
